As a condition of entering a Submission, Contestant understands its Submissions may be viewed and used by other Contestants, and hereby grants that permission. As a condition of entering, Contestants hereby provide perpetual non-exclusive license to use the Submission in any and all media throughout the world, in perpetuity, for any purpose whatsoever, without any additional compensation, the term of which shall be the entire life of the copyright and shall be allowed to make derivative works, and/or edits to the Submission for practical or creative purposes. Should any Contestant be unwilling or otherwise unable to enter into license, or provide permissions for any reason, Contestants with the next highest score will be chosen from the remaining entries until one who is able to meet all requirements can be selected. Contestants will not be paid for their Submissions or for granting Sponsor any of these rights.
PUBLICITY: Challenge Entities reserve the right to use the Submissions to the Challenge for publicity purposes prior to, during, or after the Challenge end date, in any media, and to use the name, likeness, hometown name, of any Contestant, including all or part of their Submission throughout the world, in perpetuity, without any compensation or prior review unless specifically prohibited by law. Sponsor may, in its discretion, choose to post or distribute one or more Submissions, their creator’s name, and profile information online (including Challenge Entities’ websites, social media pages, YouTube channels and third-party affiliate websites) for promotional and entertainment purposes only. Posting of this/these Submission(s) will not mean that said Submissions are eligible to win or are a Selected Contestant. Sponsor may post Submissions in any order or sequence, with or without commentary. Sponsor has the right, but not the obligation, to provide feedback to Contestants.
PRIVACY: All personal information collected by Challenge Entities will be used for administration of the Challenge. In addition, Contestants may receive email correspondence from, or on behalf of Sponsor subject to Sponsor’s privacy policy. Sponsor uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines, and US entrants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email.
This Challenge is subject to all applicable federal, state and local laws. Void where prohibited. The internal laws of the State of Colorado will govern disputes regarding these Official Rules and/or this Challenge.
All Submissions received by the end of the Challenge Submission Period that are complete and otherwise qualified will be eligible to win. Challenge Entities reserve the right to disqualify any Contestant it finds to be tampering with the entry process of the fair play of the Challenge, or the operation of the Challenge or violating these Official Rules. Persons discovered entering under several names will be disqualified. Any submission of robotic, automatic, or programmed entries, or any entries submitted through other unapproved methods are void. Challenge Entities reserve the right to disqualify false entries or entries suspected of being false or fraudulent. All Submissions become the sole property of Challenge Entities and will not be acknowledged or returned. Challenge Entities are not responsible for incomplete, late, lost, delayed, damaged, misdirected, incomplete, void, corrupted, garbled, illegible, or unintelligible submissions and those Submissions are void and will not be accepted; nor are Challenge Entities responsible for any problems, bugs or malfunctions Contestants may encounter when seeking to enter their Submissions. Contestants are solely responsible for compliance with the Sponsor’s terms and conditions. Sponsor may prohibit a Contestant from participating in the Challenge or winning a prize if, in its sole discretion, it determines such Contestant is attempting to undermine the legitimate operation of the Challenge by cheating, deception, or any other unfair playing practices of intending to annoy, abuse, threaten, undermine or harass any other players or Sponsor representatives.
In the event of a dispute as to any Submission, the authorized account holder of the email address used to register GitHub account will be deemed to be the Contestant and must comply with these Official Rules. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each Contestant may be required to show proof of being an authorized account holder.
Sponsor is not responsible and shall not be held liable, and Contestant’s entry may be disqualified and may not be considered for any Prize, should a Submission be removed from GitHub for any reason.
Challenge is subject to these Official Rules. By participating, Contestants agree: (i) to be bound by these complete Official Rules and the decisions of Sponsor which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Challenge or these Official Rules, except where prohibited by law. By accepting a prize, Selected Contestant and Runners Up agrees to release Sponsor, including their parent, subsidiary and affiliated entities together with the respective directors, employees, officers, licensees, licensors and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Challenge (collectively, the “Releasees”) from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize-related activities. Releases shall not be liable for: (i) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (ii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iii) any injuries, losses or damages of any kind, including death caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (iv) any printing, typographical, administrative or technological errors in any materials associated with the Contest.
Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Challenge.
Sponsor may prohibit an entrant from participating in the Challenge or winning prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Challenge in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsor representatives. Use of automated entry devices or programs is prohibited. Caution: any attempt to deliberately damage or undermine the legitimate operation of the Challenge may be in violation of criminal and civil laws and will result in disqualification from participation in the challenge. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.
Sponsor reserves the right to cancel or suspend the Challenge, in its sole discretion, should it receive too few entries, or receive no entries that are judged to have sufficiently met the criteria, or due to circumstances beyond its control, including natural disasters. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Challenge should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Challenge.
